Civil Litigations

Litigations may come in three (3) forms.  First, we have criminal litigations wherein a person is being charged of a certain crime.  Criminal litigations are usually long because it requires a full-blown trial in consonance and in compliance with the provisions of law regarding the right of the accused to be heard.  The guilt of the accused must be proved beyond reasonable, otherwise, he or she must be declared innocent.

Next we have the so-called administrative litigations or those cases that are basically administrative in nature.  A person who is charged with an administrative case will not be imprisoned if found guilty, unlike in criminal litigations.  The only sanction will be the removal of the person charged from the position that he or she previously held.

The third one concerns civil litigations.  Just like administrative cases, civil litigations do not entail incarceration as a form of punishment.  What is involved in civil litigations is usually the imposition of award of damages in favor of the victim.  This is the primary sanction that the law imposes on persons being charged with a civil case. There is no imprisonment or removal from a certain position as punishment to the culprit.  Civil litigations are actually very broad in scope and general in character.  However, the usual cases in civil litigations involve the negligent conduct of one person that resulted to personal injuries of another person.
