Patent

A patent is defined as a set of exclusive rights granted by a state to the inventor for a fixed period of time in exchange for the regulated, public disclosure of certain details of a device, method, process or invention found to be new inventive and industrially useful. When somebody is given a patent, he is granted an exclusive right to exclude other entities from making, using or selling the patented invention.

When somebody wants to obtain exclusive rights for an invention or a method, he can file for a patent by applying at the relevant patent office. Usually the patent office will then examine the usefulness of the invention and see if the invention complies with the requirements of the relevant patent law, before they grant the patent to the inventor. If the application is not compliant with the requirements, the application is then rejected.

Patent infringement, on the other hand, is the utilization of an invention or a method of another person or entity without the permission of the patent proprietor. There are certain types of patent infringement: direct infringement, wherein a person infringes a patent by making, using or selling a patented invention without permission; and indirect infringement, when one sells or makes a product which can only be reasonably used to make the patented device. Under US law, a patent owner is entitled to either a reasonable royalty or lost profits that resulted from the infringement of their patent, plus any punitive damages and legal fees.
