California State Workers Comp
The workers compensation is a product of progress in the early 20th century when a lot of work related injuries were happening yet no law applicable to provide fair compensation for the employees and protect businesses from excessive lawsuits. The California Workers Compensation was formulated from the early Compensation Act.
The employer’s liability insurance can provide important coverage in addition to the worker’s compensation insurance. In the California state workers comp, the benefits that a worker will be entitled to include:
- Medical care,
- Temporary disability benefits,
- Permanent disability benefits,
- Vocational rehabilitation services, and
- Death benefits
Thus, in general, California state workers comp benefits are paid by an employer’s workers compensation insurance company. in view of the fact that the law requires all employers to maintain workers compensation insurance, and in failure to do so exposes the employer to significant fines and penalties.
There are different approaches on how the coverage structured in a Workers’ Compensation policy from state to state, since California State Worker’s comp coverage is offered under Part One of a Worker’s Compensation Insurance policy. It is stated in Part One that the Insurance Company agrees to promptly pay all benefits and compensation due to an injured worker. Employers Liability insurance can give important coverage in addition to workers’ compensation insurance.
Other than that, Employers Liability is offered under Part Two of a workers’ compensation and Employers Liability Insurance Policy. Employers Liability Part Two protects the employer against instances wherein an employee’s injury or illness is not considered work related.
With this, every employer has no excuse not to purchase an insurance policy for his employees. If he fails to insure his employees, he is liable for violating the California Labor Code. If the authorities find out that this is the case in a certain company, they can order a stop to the company’s operations until the employer secures a California state workers comp insurance for his employees.
