Workers Comp Benefits

In workers compensation laws, an employee is automatically entitled to certain benefits whenever the employee suffers from an accidental personal injury arising out of and in the course of employment.

There are six basic types of workers comp benefits available, depending on the nature, date and severity of the worker's injury. These are the following:

  1. Medical Care,
  2. Temporary Disability Benefits,
  3. Permanent Disability Benefits,
  4. Vocational Rehabilitation Services,
  5. Supplemental Job Displacement Benefits, and
  6. Death Benefits

Injured workers are entitled to receive all these workers comp benefits, with no deductible or co-payments by the injured worker.

Workers comp benefits covers most, but not all, on the job injuries. The workers compensation system is designed to provide benefits to injured workers, even if an injury is caused by the employers or employees carelessness. But there are some limits. Generally, injuries that happen because an employee is intoxicated or using illegal drugs are not covered by workers compensation.

Furthermore, most employees are qualified for workers compensation coverage, but every state excludes some workers. Exclusions often include the business owners, independent contractors, domestic employees in private homes, farm workers, maritime and railroad employees, casual workers and others.

Plus, the workers compensation varies from state to state. Therefore, it is advisable to check the workers compensation law of every state to see whether those exclusions affect every individual. In comparable to this, Federal government employees are also excluded from state workers’ compensation coverage, but they receive workers’ compensation benefits under a separate federal law. But in other state program, they do not require workers’ compensation coverage of employers having less than a designated number of employees

On the other hand, every claim submitted by an employee for workers comp benefits is investigated to determine if the injury and occurrence is compensable as outlined within the state’s Workers Compensation Act.
